SOCIAL DEMOCRATIC-PARTY (PSD), legal entity of public law, based in Bucharest, 10 Soseaua Kiseleff, 1st district, which operates in accordance with Law no. 14/2003 on political parties, is the data controller for the personal data submitted though the website www.psd.ro (hereinafter “the website”).

The privacy of your personal data represents one of the main concerns of the SOCIAL DEMOCRATIC PARTY, in its capacity as data controller. This document aims to inform you on how your personal data are processed, when using the website www.psd.ro.

According to the requirements of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the “General Data Protection Regulation”, “GDPR”), as well as of the Law no. 190 of 18 July 2018 on measures for the implementation of GDPR, we must manage personal data that you supply by using our website safely and only for the specified purposes, in accordance with the GDPR provisions.

II. Categories of personal data processed

If you are a user of the website, www.psd.ro will process your personal data such as:

II.1 Family name and first name, e-mail address or any other personal data you have chosen to send to us (data supplied within the contact section, to the extent to which you choose to contact us by using this method).

II.2 Data regarding the manner in which you use the website, e.g. your habits/preferences/customs on www.psd.ro, by collecting data, such as: the device operating system, the browser and its settings, information stored in cookies, IP address, the geographical location of the device.

III. Purposes and reasons for data processing

Personal data submitted through this site and personal data that we have collected from you, from third parties, or from open sources shall be used for the purposes specified in this Data privacy policy document.

If you are a user of the website www.psd.ro, we may use your personal data for the following purposes:

III.1. For information activities, based on the legitimate interest of the data controller pursuant to art. 6 para. (1) f) of the GDPR: if you contacted us through this website, by using the contact form or any other method. 

III.2. Marketing and public relations, based on you consent, pursuant to art. 6 (1) f) of the GDPR: for behaviour analysis and traffic monitoring, the following data are analysed: the device operating system, the browser and its settings, information stored in cookies, IP address, the geographical location of the device. The latter represent data collected and managed by third parties, such as Google, Facebook etc. and these cannot be used in order to identify you.

III.3. In order to ensure the website security, based on the legitimate interest of the data controller pursuant to art. 6 para. (1) f) of the GDPR: if you are a visitor of this website, we may process the personal data that you have uploaded, the data that have been automatically collected about you or about your device in accordance with this privacy notice (e.g., through cookies, web beacons) in order to maintain the security of this website against fraud, in order to protect PSD and third parties’ rights and interests and in order to protect intellectual property rights. We specify that such information may be disclosed for the purposes of criminal investigation or prosecution.

IV. The data processing period

In principle, www.psd.ro will shall process your personal data as long as it is required in order to achieve the above-mentioned processing purposes, except for the situations where such data must be retained for a longer period, in order to comply with legal obligations that the data controller is bound with.

V. Disclosure of personal data

In order to achieve the processing purposes, www.psd.ro may disclose your data to partners, third parties or entities that support www.psd.ro in undertaking its activity through the website, or to central/local public authorities, in the following indicative circumstances:

• for website management;
• for the maintenance, update and improvement of the website;
• in order to perform data analysis and monitoring of usage and activity trends;
• when disclosure of personal data is stipulated by law etc.

VI. Transfer of personal data

Personal data transferred to www.psd.ro may be transferred outside Romania, only to European Union Member States.

VII. Your rights

According to the terms of the legislation in the matter of personal data processing, as data subjects, you benefit from the following rights:

• Right to information, respectively the right to receive details on data processing activities undertaken by www.psd.ro, according to this document;
• Right to gain access to data, respectively the right to obtain a confirmation from www.psd.ro regarding the processing of personal data, as well as details regarding the data processing activities, such as the manner in which data is being processed, the purpose of processing, the recipients or categories of data recipients etc.;
• The right to rectification, respectively the right to determine correction, without any undue delay, by the www.psd.ro of inaccurate/unjustified personal data, as well as to fill in any data gaps; the rectification/addition shall be communicated to each recipient of such data, except when this is deemed impossible or it entails disproportionate efforts.
• The right to deletion of data, without undue delays (“the right to be forgotten”), in case when one of the following reasons is applicable:
  • they are no longer required for the fulfilment of the purposes in relation to which they have been collected or processed
  • in case the  consent has been withdrawn and there is other legal reason for processing;
  • in case the data subject objects to the processing and there are no prevailing legitimate reasons;
  • in case personal data have been unlawfully processed;
  • in case personal data must be deleted in order to comply with a legal obligation;
  • personal data have been collected in relation to the offer of information society services in accordance with EU or domestic law that the data controller is subject to.

It is possible that, as a result of the request to delete data, www.psd.ro should redact such data (depriving them of any personal nature) and continue processing in such terms for statistical purposes;

• the right to restrict processing to the extent to which:
  • the data subject challenges the accuracy of data, over a period that allows us to check the accuracy of data;
  • the processing has been unlawful and the data subject opposes the deletion of the personal data, demanding in exchange that their use be restricted;
  • the data controller no longer needs the personal data for processing purposes, yet the data subject demands them in order to establish, exercise or defend a right in court; or
  • the data subject opposed to processing (other than the direct marketing related one), for the period when a check is performed whether the legitimate interests of the data controller prevail over those of the data subject.
• right to data portability, respectively (i) the right to receive personal data in a structured manner, used on a regular basis in an easily readable format as well as (ii) the right for such data to be sent by www.psd.ro to another data controller, to the extent to which the conditions of the law are fulfilled;
• the right to object – as regards the data processing activities may be exercised by submitting a request in accordance with those indicated below:
  • in any given moment, due to reasons related to the specific situation of the data subject, so that the respective data should be processed pursuant to the legitimate interest of www.psd.ro or pursuant to public interest, except for those cases where www.psd.ro may demonstrate that they have compelling legitimate reasons justifying data processing which prevail over the interests, right and freedoms of the data subjects or that the purpose is to establish, exercise or defend a right in court;
  • in any given moment, free of charge and without any justification, so that the respective data are to be processed for the purposes of direct marketing.
• the right not to be subjected to an individual automated decision, respectively the right not to be subject of a decision taken solely based on automated data processing activities, including by creating profiles, which results in legal effects aimed at the data subject or which affects him/her in a similar manner to a significant extent;
• the right to notify National Authority for Data Protection Supervision or the courts having jurisdiction, to the extent to which you deem this necessary.
